Model for FM-Agreement

To turn an initial service into a long-lasting business relationship with a mutual win-win situation.

In the field of Facility Management you can find very different levels of quality in terms of contracts and legal specifications. There are no practice-oriented allegations or helpful patterns for regulating contractual relations between employers of Facility Management and contractors, whatsoever. Individual “solutions“, imbalances or lobbying, even contractual shortcomings are the result. The consequences: small learning curves, weak points and voids in the contract, an intermingling of legal regulations and service specifications, misunderstandings down to avoidable quarrels between all parties involved.

AIS Management initializes a association spanning task force

AIS Management took the chance to initialize a task force with the two big Facility Management associations to meet these shortcomings.

The taskforce with the GEFMA e.V. and RealFM e.V. kicked off in the autumn of 2003 lead by AIS Management. AIS Management was in charge of the organization and got involved both personnel and technical wise by dispatching Wolfgang Moderegger (managing director) and Michael Laun (center of competence TGM). RealFM e.V. was represented by Paul Stadlöder (Managing Director) and Dipl.-Ing. Andrea Stadler. GEFMA e.V. was represented by Ulrich Glauche (Rödl & Partner GmbH).

For the first time practice oriented model service specifications along with a corresponding model contract as a standard were developed, with support from renowned companies from the automobile industry, the energy industry, the media, but also from leading facility management service providers and others. The board consisting of representatives of both the employer and service providing side, experienced practitioners, lawyers as well as representatives of associations and standardization boards ensured a well-balanced design and a broad acceptance of the agreement.

Span of Application of this Model Contract

The model contract Facility Management is conceptualized for services during the operating stage of buildings as well as for the time of vacancies and offers support for regulating the placing of orders and contractual relations between the employer and the service provider. Preferably, the model contract should be deployed along with the corresponding model service specifications. Both papers have been worked out as a whole in order to complement each other at the best possible rate.

The model contract was published for the first time at the end of 2004 by GEFMA e.V. and RealFM e.V. along with the model service specifications Facility Management.

Model Contract 2.0 / English Version

The constructive suggestions made by users of the model contract along with the will of the combined task force to meets its own standards in constantly adapting the model contract to the Facility Management market were the reasons for making the present version 2.0. It evolved from a close co-operation with the European Norm DIN EN 15222 committee "Facility Management Agreements - Guidelines for developing Contracts in the Field of Facility Management" and is now already compatible with the official draft of this future norm.

In order to meet the increasing internationalization on the Facility Management market this contract is now also available in English (German law is applicable here).
